It is an absolute condition for the payment of any commission that Broker accompanies and registers a prospective purchaser at Mesa Ridge at the time of Buyer’s first visit. Broker shall not be entitled to any commission if Buyer has visited Mesa Ridge without Broker prior to the date of this registration or if Buyer has registered with this community via any means, including but not limited to, web site, phone-in, mail-in, or referral from another community. The registration ofthe Broker shall be established only for the particular Buyer registered above and shall be valid for a period of six (6) months. Seller shall pay to Broker a commission equal to three percent (3%) of the base sales price ofthe home purchased. The base sales price does not include the value of any incentives provided by the seller or any options or upgrades even if these options and upgrades are included in the final closing price of the home. This commission shall be paid to the Broker in escrow upon recordation of the grant deed transferring ownership from the Seller to the Buyer. If another real estate sales person or Broker attempts to register as a Buyer's Broker, Seller shall be obligated to pay a single commission to the Broker who first registered this Buyer at Mesa Ridge assuming a closing occurs and all other criteria have been met. Broker represents that he is a licensed real estate Broker or salesperson in the state ofCalifornia and that, to the extent required by law, Broker must provide an executed form ofdisclosure, between Broker and Buyer, of his agency relationship with Buyer. Seller’s on-site agent shall be responsible for coordinating loan processing, escrow, and all appointments related to this transaction. Broker agrees, however that if requested by Seller, Broker will assist Seller in obtaining documentation or other information from Buyer with respect to his loan, loan closing, or escrow documentation for the closing of this transaction.
